Before C.L. Long Justice of the Peace
In and for the City of Coffeyville, Kansas.
State of Kansas
vs Plaintiff
Emmet Dalton
Defendant
H. M. Stansbery of lawful age
being duly sworn according to law
on his oath says that at the County
of Montgomery and State of Kansas on or
about the 5th day of October in the
year 1892 then and there being one
Emmit Dalton did unlawfully
Feloniously premeditatedly willfully
and of malice aforethought shoot
at and into the body of one
George Cubine and did kill and
murder the said George Cubine. Then
and there being by shooting him
the said George Cubine with a certain
gun commonly called a Winchester Rifle
then and there loaded with powder
and leaden bullets which said Winchester
rifle loaded with powder and leaden
bullets as aforesaid the said Emmet
Dalton then and there in his hands
had and held contrary to the statutes
in such cases made and provided
and against the peace and dignity
the state of Kansas.
